Recently there has been a controversy between YamiSweet and the administrators of Bowlroll.net. The gist of it is that Bowlroll had removed some of her files from their server due to "TOS violations". However, this discussion isn't about this controversy as it's well documented and as far as the two parties are concerned it seems to have been resolved amicably and I am not, in writing this article, attempting to re-ignite the discussion. I have been an admirer of Ms.YamiSweet work for quite awhile and I am definitely impressed by her level of maturity. In addition, I really do feel she did all she could to handle the situation well. As unlike many DA MMDers, she has, to the best of my knowledge, always taken pains to do things correctly.

Even if there a rumor with photo, it's not enough to indicate overall the fact.
People can warp original event during relaying messages, so hearing a rumor on the grapevine easily changes its original means.
Moreover, there are people who plots intentional misunderstanding between others for only his/her benefit.
We should keep careful to treat rumors, getting multiple sources, disclosing rumor's identity, and NOT TO BELIEVE A NEWS WITH SINGLE SOURCE.
In www, a false information can be easily spread into all over the world.
So we should teach how to prevent these issues not only for them, but only for us.

WHAT'S THIS ALL ABOUT
This all started when I saw a page created by RaikuHoshigami in which he presented the Terms of Usage which Japanese modeler Arlvit uses in the readme.txt that accompanies his model of Touhou character Sakuya Izayoi for MMD.

To keep this brief, basically I found it an interesting exercise to see exactly how valid those terms really are from a purely legal sense, and by extension how valid other rules created by other MMD modelers and MMD model editors actually are. Note that I prefixed the last two groups with "MMD" and that is because this article will only discuss models made specifically for MMD (Miku Miku Dance). These restrictions and definitions are necessary for reasons that should be obvious as you read on.

DeviantArts (DA) is probably unique in several ways, but the thing that I've found strangest and have had the most difficulty with grappling with is their tolerance(?) of "rips". Which is why I think this could be an interesting discussion.
"Rips" are models taken from commercial computer and video games and used for "something else". Make no mistakes about it, probably 99.99% of rips are illegal in the sense that they were "stolen" from something else. Which, given the existence of the Digital Millennium Copyright Act (DMCA), makes it kind of strange that DA tolerates any rips on their servers at all. May be they really do deserve the kind of reputation that they receive on other forums on the Internet, or they just aren't making enough money to be worth the bother to sue. Who knows? The fact remains is that at the moment DA seems to be a safe haven for rippers and nowhere are they perhaps more visible than in the MMD field.

One Christmas when I was a child, my relatives in Switzerland sent me a wooden puppet. It was a beautifully handcrafted mannequin to which strings were attached. There was this wooden cross like "controller" which you held in the hands and I've never managed to get the dang thing to work ...
That was a long time ago and in all honesty I don't even remember what happened to that puppet but I figure that if I still had it, it could probably be sold on EBay for a nice amount.
Then about this time last year, out of sheer boredom and a certain degree of curiosity I downloaded a copy of Miku Miku Dance (MMD). I loaded it up and probably like 99.99% of all users of that software, I then loaded one of the three Miku Hatsune models that comes with the package.
For some reason, she reminded me of that wooden puppet (correctly it's called a marionette) from my childhood days. There were obvious differences, not least of which was

There are very few topics that elicit more "passionate" discussions within MMD than the controversy surrounding what are generally referred to as "Illegal Edits". Now, I've publically made the statement that I did not believe that there's such a thing as an "Illegal Edit", but then again that's just an opinion.
I could be totally wrong too.
Which is why, I felt it would be a useful exercise to look at this issue in a rational manner purely for the purposes of discussion. The views presented herein, are solely mine. Although, I will be touching on the subject from a "Legal" perspective, let me state clearly that I am not a lawyer, so what is presented here is my interpretation which may or may not be correct.
